Terms and Conditions

2.1 How You Accept These Terms

You accept these Terms by doing any of the following:

• Visiting or browsing poppyblum.com;
• Creating an account or completing registration;
• Using the AI concept board generation feature, Canvas Studio, Save & Get Materials / Build Kit retail features, or any paid feature;
• Accepting these Terms where presented during account creation or checkout;
• Completing a purchase (Event Pass, Pro subscription, or AI add-on credits).

If you do not agree to these Terms, you must immediately stop using the Service.

2.2 Modifications to These Terms

Poppy Blum reserves the right to modify these Terms at any time. When we make material changes, we will:

• Update the “Last Updated” date at the top of these Terms;
• Post the revised Terms at poppyblum.com/terms-of-service;
• Notify registered users by email at least 14 days before material changes take effect.

Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the updated Terms. If you disagree with any modification, your sole remedy is to stop using the Service and, if applicable, cancel your subscription.

4.1 Account Creation

Certain features require an account. AI concept board generation requires a registered account (Free or paid tier). Free accounts receive three (3) lifetime watermarked AI concept generations, enforced server-side. Without an account, you may browse the site and view marketing content, but you cannot generate AI concept boards. An account is required to:

• Generate AI concept boards;
• Save design concepts or canvas boards;
• Access the Studio Dashboard;
• Purchase an Event Pass, Pro subscription, or AI add-on credits.

To create an account, you may register using an email address and password, or authenticate using Google OAuth through Supabase Auth. You agree to provide accurate, current, and complete registration information and to update that information as needed.

4.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your account credentials;
• All activity that occurs under your account, whether or not authorized by you;
• Immediately notifying us at hello@poppyblum.com if you suspect unauthorized use of your account.

Poppy Blum will not be liable for any loss or damage arising from your failure to maintain account security. You agree not to share your account credentials with any third party.

4.3 One Account Per User

Each user may maintain only one active account. Creating multiple accounts to circumvent credit limits, free tier restrictions, or any other usage policy is a violation of these Terms and may result in immediate termination of all associated accounts.

4.4 Account Accuracy

You agree not to impersonate any person or entity or use a false identity when creating an account. We reserve the right to refuse registration or cancel accounts at our sole discretion.

5.1 Service Overview

Poppy Blum provides an AI-powered event decor planning platform. Features available to you depend on your tier. The Canvas Studio editor requires a desktop or laptop viewport of at least 1024px wide; smaller devices may show a prompt to continue on desktop.

5.2 Credits and Add-Ons

Paid tiers include two separate metered allowances. AI generation credits are consumed when you initiate an AI concept board generation. Material sourcing runs are consumed when you start a Save & Get Materials search from a canvas. Canvas board saves are not deducted from either allowance.

A sourcing run is automatically returned to your allowance if the search fails because of a system error on our side before results could be produced. A search that completes but finds no matching products is a delivered result and consumes the run.

Event Pass holders may purchase add-ons while the pass is active: +1 AI generation credit per $1.99 purchase, or +3 sourcing runs per $1.99 purchase. Credits, sourcing runs, and add-ons are non-transferable between accounts and non-refundable once consumed.

5.3 Event Pass: 90-Day Expiration

Event Pass access, included AI credits, and included sourcing runs expire 90 days from the date of purchase, regardless of how much of either allowance remains unused. Expired access, credits, and runs are forfeited with no refund. Add-on purchases (AI credits and sourcing run packs) expire with the pass and do not extend the 90-day expiration window.

5.4 Pro Subscription: Monthly Reset

Pro subscription AI credits and sourcing runs reset on your billing cycle date each month. Unused credits and runs do not roll over. Poppy Blum reserves the right to adjust the monthly allocations with at least 30 days' prior notice to active subscribers.

5.5 Feature Availability

Poppy Blum reserves the right to modify, add, or remove features from any tier at any time. For paid tiers, material reductions in features will be communicated with at least 30 days' notice where reasonably practicable.

6.1 Payment Processing

All payments are processed securely by Stripe, Inc. By purchasing an Event Pass, Pro subscription, or add-on (AI credits or sourcing run packs), you authorize Stripe to charge your payment method. Poppy Blum does not store your full payment card details on its servers.

6.2 Pricing

Current pricing (US dollars, plus applicable taxes):

• Event Pass: $7.99 one-time (90-day access, 10 AI generation credits, 10 sourcing runs);
• AI Add-On (Event Pass only): $1.99 for +1 AI generation credit;
• Sourcing Run Add-On (Event Pass only): $1.99 for +3 material sourcing runs;
• Pro Monthly: $19.99 per month;
• Pro Annual: $149 per year.

Poppy Blum reserves the right to change prices with at least 30 days' notice for existing subscribers where required by law.

6.3 Subscriptions and Auto-Renewal

Pro subscriptions recur automatically until cancelled through your account settings or the Stripe Customer Portal. Cancellation takes effect at the end of the current billing period; you retain Pro access through that date.

6.4 Refund Policy

Due to the digital and immediately consumable nature of the Service:

• Event Pass: No refund once at least one (1) AI credit has been used. If no credits have been used, contact us within 48 hours of purchase for a full refund.
• Add-On Purchases (AI credits and sourcing run packs): No refunds once purchased, as they are added to your account immediately.
• Pro Monthly: No refund for the current billing period. Cancel before renewal to avoid future charges.
• Pro Annual: A pro-rated refund for unused months may be requested within 30 days of purchase if fewer than 2 billing months of service have been used.

Email hello@poppyblum.comwith the subject line “Refund Request” and include your account email and purchase date. We aim to respond within 5 business days.

6.5 Chargebacks

If you initiate a chargeback without first contacting us, we may suspend your account pending resolution. Fraudulent chargebacks may result in permanent termination.

8.1 Unauthorized or Abusive Use

• Creating multiple accounts to circumvent credit limits or bans;
• Using automated tools, bots, scrapers, or crawlers to access or extract data from the Service;
• Reverse-engineering, decompiling, or discovering source code or underlying algorithms;
• Probing or testing vulnerabilities without our written consent;
• Bypassing authentication, access control, or abuse-prevention mechanisms (including generation credit limits).

8.2 Harmful or Illegal Content

• Inputting unlawful, defamatory, obscene, threatening, or harassing content;
• Using the Service to plan or promote illegal activities;
• Submitting third-party personal information without consent;
• Using the Service in any manner that could expose Poppy Blum to legal liability.

8.3 Intellectual Property Violations

• Reproducing or distributing Service content without permission;
• Removing or altering copyright, trademark, or proprietary notices;
• Using Poppy Blum branding without authorization.

8.4 Commercial Misuse

• Reselling or commercially exploiting AI-generated outputs without our written consent;
• Offering competing services using outputs generated by the Service;
• Using the Service to build or train competing AI models.

9.1 Poppy Blum's Intellectual Property

The Service, including its software, design, user interface, graphics, logos, trademarks, canvas asset library, and templates, is owned by Poppy Blum LLC and protected by applicable intellectual property laws. You may not reproduce or create derivative works without our prior written consent.

9.2 Your Content

You retain ownership of event details, design data, canvas configurations, and uploads you provide (“User Content”). You grant Poppy Blum a non-exclusive, royalty-free license to use, store, display, and process User Content solely to provide and improve the Service. You represent that you have the rights to submit your User Content.

9.3 AI-Generated Outputs

AI-generated concepts, palettes, suggestions, and hero imagery are provided under these Terms for personal event planning. Commercial use requires our prior written consent. AI outputs may not be unique; similar outputs may be generated for other users. Poppy Blum makes no warranty that AI outputs are protectable under copyright law.

9.4 Feedback

Feedback you provide may be used by Poppy Blum without obligation to compensate you.

12.1 "As Is" Service

12.2 No Professional Advice

Nothing in the Service constitutes professional design, financial, or legal advice. Consult qualified professionals where expertise is required.

12.3 Third-Party Services

Poppy Blum is not responsible for outages or practices of integrated third-party services, including Stripe, Supabase, our third-party AI providers, SerpAPI, PostHog, Sentry, Vercel, or Railway.

15.1 Termination by You

You may terminate your account by contacting hello@poppyblum.com. We will process deletion requests within 30 days. Cancelling a Pro subscription stops future billing but does not automatically refund the current period (see Section 6.4).

15.2 Termination by Poppy Blum

We may suspend or terminate your access for Terms violations, fraud, abuse, non-payment, circumvention of limits, extended inactivity (with 30 days' notice for inactive free accounts where practicable), or conduct harmful to users or the Service.

15.3 Effect of Termination

Upon termination, your license ends and we may delete account data subject to our Privacy Policy and legal retention obligations. Sections 9, 12, 13, 14, 16, and 17 survive termination.

17.1 Informal Resolution

Before formal proceedings, contact hello@poppyblum.com with a written description of your dispute. We will attempt informal resolution within 30 days.

17.2 Binding Arbitration (US Users)

17.3 EU / UK Users

Mandatory arbitration does not apply. You may bring claims in your country of residence and use the EU ODR platform at ec.europa.eu/consumers/odr.

17.4 Small Claims

Either party may bring qualifying claims in small claims court in Hennepin County, Minnesota.
